Characteristics of intellectual property rights with foreign elements in Viet Nam - The development of intellectual property rights with foreign elements in Vietnam is always associated with viewpoints and policies of our Party and State in innovation of legal thinking and international integration in the justice and law field. - Intellectual property rights with foreign elements in Vietnam are protected and enforced in accordance with international law, Vietnamese laws, traditions and cultures of ethnic groups of Vietnam. - Development of intellectual property rights with foreign elements in Vietnam in recent years has partly influenced psychology and lifestyle of Vietnamese people , creating "fashionable chasing effect" of a small group of Vietnamese people. - The establishment of intellectual property rights with foreign elements in Vietnam could be limited in some certain cases. 2.2. Some theoretical issues on the enforcement of intellectual property rights and intellectual property rights with foreign elements in Vietnam 2.2.1. Definition, characteristics of the enforcement of intellectual property rights with foreign elements in Viet Nam 2.2.2.1. Duties of People’s public security force in intellectual property rights enforcement with foreign elements in Viet Nam The task of People’s public security force is specific activities conducted in a certain period in accordance with the functions of the People’s public security force. To accomplish its mission, People’s public security force must use authority, conditions , technical facilities and work measures, coordination with other agencies, organizations and individuals on the basis of legal provisions, People’s public security force has the task of national security and social order and safety protecting related to intellectual property rights with foreign elements in Viet Nam, such as information gathering, analysis, evaluation, forecasting and proposal to Party and State to issue guidelines and policies, legislation, protection strategies of national security, social order and safety preservation, petition requirement combination of strategy of national security protection, social order and safety preservation with strategy of building, development of economy, society, defence and foreign affairs of State; protecting freedom, democracy, life and property of people, protecting senior leaders of Party, State and international visitors, protecting significant events, key objectives, projects in national security strategy, foreign representative bodies, international organization representatives in Vietnam, individuals keeping or closely related to State secrets. Chapter 3 THE REAL SITUATION OF ENFORCEMENT OF INTELLECTUAL PROPERTY RIGHTS WITH FOREIGN ELEMENTS OF PEOPLE’S PUBLIC SECURITY 13 3.1. The reality of law and law breach of intellectual property rights with foreign elements in Vietnam 3.1.1. The reality of enforcing intellectual property rights with foreign elements in Vietnam 3.1.1.1. The above treaties do not have direct regulations on the implementation of intellectual property rights with foreign elements in Vietnam; however, expressed princintellectual propertyles, solutions and requirements on the enforcement of intellectual property rights have huge impacts on the construction, application and improvement of Vietnamese law according to general international standards on intellectual property. 3.1.2. The real situation of violation of intellectual property rights having foreign elements in Vietnam 3.1.2.1. The fact of acts of infringement of copyrights and rights relating to foreign elements in Vietnam The part presents the fact of acts of infringement of copyrights and related rights having foreign elements in Vietnam recently. Holders of law violation were diverse; illegal acts were performed sophisticatedly in different fields, namely areas of printing, publishing, advertising, radio and television, etc. Particularly, enemy forces have made corrupt use of copyrights and related rights having foreign elements in Vietnam to disseminate and against revolutionary career of Vietnamese Party and State. It puts a heavy responsibility on people’s public security in struggling, preventing and resisting the above illegal actions. 3.1.2.2. The necessary of issuing documents guiding directly and organizing the enforcement of intellectual property rights having foreign elements in Vietnam of people’s public security forces - The laws of advisory work for the Party and the State to protect and preserve national security and social order and safety related to the enforcement of intellectual property rights having foreign elements in Vietnam should focus on sensitive issues related to national security and social order and safety. - The legislation in the field of State management of the enforcement of intellectual property rights having foreign elements in Vietnam related to the enforcement of intellectual property rights having foreign elements need to build new coordination regulation with people’s public security with forces executing of intellectual property rights having foreign elements in Vietnam. - The direct legislation provisions of the fight against crimes and violations of intellectual property rights having foreign elements in Vietnam of people's public security should have a decree specified the working measures of people's public security forces. 21 4.2.1.3. Supplement provisions of the law by increasing the activities of law enforcement agencies in other coordinating relations with the people’s public security on the enforcement of intellectual property rights having foreign elements in Vietnam. - There should be a focal point for receiving and handling complaints about intellectual property in the direction of “one door” and simplifying administrative procedures. - It needs innovative thinking in preventing and combating intellectual property rights violations. - It should be assigned specific responsibility for law enforcement agencies, a focal point for receiving and handling the infringement of intellectual property rights having foreign elements in Vietnam. - Promote the position of directly fight against crimes and violations of intellectual property rights having foreign elements in Vietnam of people’s public security. 4.2.2. Solutions to build force and perform measures in the enforcement of intellectual property rights having foreign elements in Vietnam of people’s public security forces 4.2.2.1. There should be assigned clearly according to hierarchy about functions, tasks and coordination in enforcement of intellectual property rights having foreign elements in Vietnam of forces units in people’s public security to unify operational objectives - Need to have clear regulations on which kinds of cases handled under the authority of people’s security and which under that of people’s police; - Develop coordination between people’s security and people’s police in investigating and handling to avoid omitting crime and legal breach of intellectual property rights having foreign elements in Vietnam. 4.2.2.3. Need to further enhance the training and education of knowledge about INTELLECTUAL PROPERTY law for each staff and soldiers in people's police security - Need to have plans and training programs to foster deeper for officers and soldiers of people’s public security the knowledge of intellectual property law. - Expand the dissemination of knowledge about intellectual property law in full force especially the standing foot unit in the area sensitive, prone to abuses of intellectual property rights in general and have weak intellectual roofer foreign elements in Vietnam in particular. - Planning and programs with foreign partners , international organizations in order to exchange experiences, share information and technical assistance to implement the 22 INTELLECTUAL PROPERTY RIGHTS enforcement activities to achieve the highest efficiency . - To strengthen the apparatus of people’s public security forces to meet the content requirements intellectual property rights enforcement has foreign elements in Vietnam. - Coordinate with training institutions, professional bodies within and outside the sector under the program, specific projects; which is parallel to push the compilation of monographs, collected materials for the training of intellectual property rights. 4.2.2.4. Need to boost synchronous process to control violation situation of intellectual property rights having foreign elements in order to proactively detect, prevent and combat the infringement of national security and social order and safety - Organize to understand well the situation involving intellectual property rights infringements in general and intellectual property rights having foreign elements in Vietnam in particular on the basis of improving quality and efficiency in the work associated with work of the entire population movement to protect national security, linking intellectual property enforcement issues having foreign elements to implement effectively national program of crime prevention. - Develop a mechanism for processing information in a flexible way and need a focal point for receiving, processing information at all levels, in which the most important is the Ministry of Public Security. 4.2.2.5. People’s public security forces should cooperate with organizations and individuals involved actively do a good job of preventing intellectual property rights having foreign elements in Vietnam. - The law construction and enforcement agencies have to coordinate closely with media agencies to deliver news, documents and regulations of the state on intellectual property rights. The information on intellectual property rights must be managed by technologies that are advanced, modern and convenient for study and application. - People’s public security forces need to continue the implementation of guidelines for organizations and individuals in and outside the country to protect the intellectual property rights. In addition, it is needed to mobilize scientists, knowledgeable professionals engaged in intellectual property rights enforcement has foreign elements in Vietnam. 4.2.2.6. People’s public security force needs strengthen international cooperation with other nations and international organizations to struggle and prevent crimes and the legal violation of intellectual property rights having foreign elements in Vietnam. - Counsel and be initiative to propose with competent government agencies to conduct exchanges and negotiations with foreign countries, especially the countries 23 sharing borders with Vietnam to sign cooperation documents on preventing crimes of intellectual property rights infringement. - Build a network of communication officers and collaborators of the foreign bodies. At the same time, invest modern technical equintellectual propertyment to quickly grasp the situation, gather information about crimes infringing on intellectual property rights with foreign elements in Vietnam for the requirements of fighting against crimes in the new situation. CONCLUSION The world is changing vigorously according to the trend of non-stopable and strong development of knowledge-based economy. Beside natural resources, intellectual property rights in general and intellectual property rights with foreign elements in particular have become property of great value, a element creating prosperity of each country in the international community. Currently, in the context that Vietnam is a member of WTO and is strengthening the international integration, intellectual property is more significant than ever for the development of Vietnam. Therefore, it is required that Vietnam has to promote the enforcement of intellectual property rights, especially intellectual property rights with foreign elements in order not only to combat violation of law and crime of infringement of interests that are protected by law, but also to create an impetus for foreign individuals and organizations to increase commercial and investment ties with Vietnam in a healthy environment of intellectual property. With the key role in protecting national security and keeping social order and safety, people’s public security is a representative of the State in the enforcement of intellectual property rights with foreign elements in Vietnam. In execution of its functions and duties, people’s public security acts as a counsellor for the Party and State on national security and is also a state management agency in national security and social order and safety, as well as an agency taking charge of executing proceedings and directly struggling for prevention and fighting of crimes and acts of infringement of intellectual property rights with foreign elements. Thus, highly effective enforcement of intellectual property right with foreign elements in Vietnam by people’s public security contributes to stabilizing and developing the country, maintaining the national independence and path to socialism construction in the conditions of international integration. In order to obtain these goals, people’s public security is in need of innovating and comprehensively reforming methods of operation, meeting requirements of the country in current context. In recent years, people’s public security forces have effectively executed their functions and duties in the enforcement of intellectual property rights with foreign elements in Vietnam, especially in the field of advisory work, state management and 24 prevention and fighting crimes and acts of infringement of intellectual property rights with foreign elements in Vietnam. The obvious achievement of people’s public security forces is that hundreds of national security violation cases relating to state’s secrets, business secrets, thousands of cases relating to production, purchase, selling and consumption of counterfeit goods, and violation of intellectual property rights with foreign elements in Vietnam were detected and tackled over the past few years, affirming the core role of people’s public security in this burning battle. However, in addition to obtained achievements, the enforcement of intellectual property right with foreign elements in Vietnam still exists some issues that need to be supplemented and improved, of which raising people’s public security’s enlisted ranks’ awareness and consciousness on laws in general, and law on intellectual property rights in particular is the first priority. Also, it is necessary to establish an agency of people’s public security that specializes in the enforcement of intellectual property rights with foreign elements in Vietnam. In addition, grasping the situations of intellectual property should be paid more attention, because if necessary information on crimes and violations of intellectual property rights with foreign elements in Vietnam is not adequately updated, effective measures and methods of enforcing laws are not put forward according to given goals. In order to effectively enforce the intellectual property rights with foreign elements in Vietnam, it is also required that the State should create comprehensive coordination mechanisms between functional departments, including: People’s public security, People’s Committee, market management, customs agencies, Inspectorate, the people’s court, people’s procuracy, etc. Simultaneously, it is essential to have an effective coordination mechanism to exchange information between Minitries, sectors, scientists, businessmen, journalists and to cooperate closely with international countries and organizations to join forces to fight crimes and combat violation of intellectual property rights with foreign elements in Vietnam. To have adequate strength to enforce intellectual property rights with foreign elements, it is required to build and complete regular, modern, lean and appropriate people’s public security forces, meeting real requirements. In addition, a complete and synchronous law system is a firm foundation for people’s public security forces to fulfill their missions in the cause of protection of national security and maintenance of social order and safety. In spite of best efforts to carry out the research, the title of the thesis is new in Viet Nam legal science with relatively wide research object and scope, so it is inevitable to have shortcomings in both contents and forms.
